Arbitration Agreement and Class Action Waiver:

By using or purchasing BricoloPro products or services, you agree that any controversy, claim, action or dispute between you and BricoloPro arising from or related to: ((a) these Terms, or your breach of them; or (b) your access to or use of the Website. BricoloPro or services or materials; or (c) any alleged violation of any federal, state or local law, statute or ordinance (each such controversy or claim, a "Claim"), shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association in accordance with its applicable rules..
Arbitration is a form of dispute resolution in which the parties agree to submit their disputes and potential disputes to a neutral third party (called an arbitrator) for a binding decision, rather than having the dispute(s) decided in a trial before a court, judge, or jury. The arbitrator shall render a reasoned award in writing, including all findings of fact and law upon which the award was rendered. The arbitrator has no authority to make errors of law and the arbitrator's award may be set aside or corrected upon judicial review by a court of competent jurisdiction. Attorneys' fees, expert fees and other costs and expenses incurred by each party in connection with the arbitration shall be borne by the party incurring them.
Arbitration procedures:
Complaints are heard by a single arbitrator. The arbitrations will be held in France, but the parties may choose to appear in person, by telephone or by submitting documents. The arbitration shall be governed by the Federal Arbitration Act (“FAA”) and the internal laws of France, without regard to conflict of laws principles. Any dispute in this regard will be resolved exclusively by an arbitrator. If, and only if, the arbitrator determines that the FAA does not apply, New York law governing arbitration agreements will apply. All disputes as to whether the above mutual arbitration provisions are unenforceable, unreasonable, enforceable, valid, void or voidable shall be decided exclusively by an arbitrator, and not by a court.
Exclusion from arbitration:
Notwithstanding the terms of this arbitration agreement, you may choose to pursue a claim in court and not through arbitration if you opt out of these arbitration procedures within 30 days from the date you first purchase any of BricoloPro (the “Withdrawal Deadline”). You may opt out by sending written notice to contact@bricolo-pro.com. Your written notice must include (1) your name, (2) your address, and (3) a clear statement that you do not wish to resolve disputes through arbitration. Your exclusion decision will have no negative impact on your relationship with BricoloPro. YOU are responsible for ensuring receipt by BricoloPro of your opt-out notice, and you may therefore wish to send notice by means that provide written receipt. Any opt-out request received after the opt-out deadline will be invalid and you will need to pursue your claim in arbitration.
Waiver of Class Action:
You and BricoloPro agree that you may bring or participate in claims against BricoloPro solely in your respective individual capacity, and not as a plaintiff or class member in any purported class, consolidated or representative proceeding. Unless you and BricoloPro n'otherwise agree in writing, the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated, and may not otherwise preside over any form of a representative or class proceeding.. Notwithstanding any other provision contained in this Agreement, any claim that all or any part of this class action waiver is unenforceable, unreasonable, void or voidable may only be determined by a court of competent jurisdiction and not by an arbitrator.
